At Brook Legal we offer a low cost fixed fee on Wills and Probate matters.

DRAFTING WILLS:

When preparing a will, we meet with you to discuss your individual situations and circumstances. At our initial meeting, we will advise you on the issues you may need to consider, such as having a blended family, and get a full picture of your requirements.

Will documentation is usually produced within 2 days for perusal, and a date is arranged for official execution of the document - within 7 days. When you return to execute your documents, we fully explain the contents in a friendly and non-threatening manner and answer any questions you may have. You'll leave our offices with a full set of documents, knowing that all your will requirements have been attended to.

We prepare wills in a simple format and/or a Testamentary Trust. We advise on issues relating to blended families, we make provision in the will to protect the assets in the event of a beneficiary becoming mentally ill or bankrupt and can make provision for excluding people to avoid potential inheritance dispute claims.

Marriage or divorce can make a Will invalid, and a change in your circumstances may require a new Will being prepared.

We will maintain an electronic copy of your will on our premises so that if you need to revise or change it for any reason we can do this quickly and easily at a much lower fee than doing a whole new will, or if lost you can re-execute it without delay, usually at little to no cost.

OBTAINING GRANTS OF PROBATE AND LETTERS OF ADMINISTRATION:

At Brook Legal, we process applications for a Grant of Probate or Letters of Administration to the Supreme Court upon the death of a loved one.

We also advise on distribution of assets.

JOINT-TENANCY AND SURVIVORSHIP:

We complete applications to transfer assets (houses, shares) to the survivor where the property is held as joint-tenancy.

ASSISTANCE WITH INHERITANCE CLAIMS

Defending applications or making a claim under the Inheritance (Family and Dependants Provisions) Act 1972 against a deceased estate.

STANDARD CHARGES

A fixed fee of $290 plus GST applies for a single will and $485 plus GST for two wills attended to together.

A fee of $150 plus GST for an Enduring Power of Attorney.

A fee of $700 plus GST for each will that includes a Testamentary Trust.
